2026년 2월 10일부터 부동산거래신고법 시행규칙이 개정되면서 매매 계약 시
계약금 지급을 증빙하는 서류 제출이 의무화되었습니다.(임대차 계약은 해당사항없습니다)
많은 공인중개사님들이 이제 겨우 이 제도에 적응하고 있었는데, 얼마 지나지 않아
전자계약 시스템의 첨부파일 등록 방식까지 다시 변경되었습니다.
특히 연세가 있으신 소장님들께서는 계약 진행 중 바뀐 화면을 보며 당황하는 경우도 적지 않습니다.
손님은 옆에서 계약을 기다리고 있고, 전자계약 화면은 달라져 있고,
“첨부파일 버튼이 어디에 있지?” 하며 화면을 찾느라 계약 진행이 잠시 멈추는 상황도 실제로 종종 발생하고 있습니다.

전자계약 시스템에서 가장 크게 달라진 부분은
계약금 증빙서류를 첨부하는 시점입니다.
기존에는 계약서를 작성하는 과정에서 반드시 첨부파일을 먼저 등록해야만
계약 생성이 가능했습니다.
하지만 이제는 계약서 작성 단계에서는 파일을 첨부하지 않아도 되며,
거래 당사자 서명이 모두 완료된 이후 첨부할 수 있도록 변경되었습니다.

즉, 이제는 계약서를 먼저 작성하고 거래 당사자의 서명이 모두 완료된 뒤
'확정대기중' 단계에서 계약금 증빙서류를 첨부하면 됩니다.

| Before vs After – Changes in the E-Contract System
The biggest change in the electronic contract system is the timing of uploading
the deposit payment proof document.
Previously, the file had to be uploaded during the contract creation stage.
Without attaching the document, the system would not allow the contract to be generated.
Under the new system, the contract can be created without attaching the file first.
After both the buyer and seller complete their signatures, the document can be uploaded
during the "Pending Confirmation" stage before the real estate agent’s final signature.
| 계약금 증빙서류 첨부 방법 (전자계약 진행 순서)
전자계약 시스템 변경 이후에는 계약금 증빙서류를
계약서 작성 단계가 아니라 거래 당사자 서명이 모두 완료된 이후에 첨부하게 됩니다.
즉, 매도인과 매수인의 서명이 모두 완료되면 계약 상태가
'확정대기중'으로 변경되는데, 이 단계에서 계약금 증빙서류를 등록한 후
공인중개사가 최종 서명을 진행하면 됩니다.
전자계약 진행 순서
- 매도인·매수인 전자서명 완료
- 계약 상태 확인 → '확정대기중'
- '나의 전자계약' 메뉴 접속
- 해당 계약 우측 하단 [첨부파일등록] 클릭
- 계약금 증빙서류 업로드
- 공인중개사 최종 서명 진행
이 과정을 완료하면 계약금 증빙서류가 시스템에 등록되고,
전자계약 절차가 정상적으로 마무리됩니다.
단, 모바일에서는 첨부파일 등록 기능이 제공되지 않기 때문에
반드시 PC에서 파일을 업로드한 후 최종 서명을 진행해야 합니다.
| How to Upload Deposit Proof Documents
Under the updated e-contract system, the deposit proof document is no longer uploaded
during the contract creation stage.
Instead, the document must be uploaded after both the buyer and seller have completed
their electronic signatures.
Once the contract status changes to "Pending Confirmation",
the real estate agent should upload the deposit proof document and then proceed
with the final signature.
